The Delhi High Court will today hear a petition filed by private broadcaster Nimbus
Communications Limited which has challenged the Sports Broadcasting (Mandatory
Sharing with Prasar Bharati) Ordinance 2007.
The ordinance, which was issued on February 2, makes it mandatory
for rights holders of sporting events to share advertisement-free live telecast
signals with all platforms of Prasar Bharati on a revenue-sharing basis.
A Division Bench comprising Justices M.K. Sharma and
Sanjiv Khanna, while admitting the petition on Friday, posted it for
hearing today. The Bench refused to give immediate relief to Prasar Bharati
on the issue of seven-minute delayed telecast of the ongoing India Vs Sri
Lanka series on Doordarshan.
Counsel for Nimbus said the ordinance transgressed constitutional
limits and violated the fundamental rights of the petitioner.
